Elder Law Attorney to Protect What You Have Worked For All Your Life and for Medicaid / Medi-Cal
Medicaid (Medi-Cal in California) has complex regulations and rules that most people find practically impossible to navigate and understand. Unless the attorney is an Elder Law practitioner, even attorneys are generally not equipped to provide precise advice about the Medicaid system and the strategies that can adequately protect clients’ income, property, or money. Incomplete or wrong advice can cost you a fortune.
For example, in many cases, reviewing documents drafted by other law firms created trusts for clients supposedly protecting their assets from Medicaid’s spend-down rules. Sadly, we have found that language in these trust agreements allowed the clients access to principal funds, thereby negating any protection the trusts might have provided.
Trusts established for long-term care planning require particular, tightly-worded provisions to function appropriately and withstand Medicaid scrutiny.
